By accessing or using Maria's services, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree to these terms, please do not use our services.
2. Service Description
Maria is an AI-powered job search platform that analyzes your CV to match you with relevant job opportunities. Our services include:
- CV analysis and optimization recommendations
- Job matching based on your profile and preferences
- Application assistance and cover letter generation
- Salary insights and market value estimation
- Interview preparation and career guidance
3. Eligibility and Account Registration
You must be at least 16 years old to use our services. By creating an account, you represent that:
- You are legally eligible to work in the jurisdictions where you seek employment
- All information provided is accurate, current, and complete
- You will maintain the security of your account credentials
- You will promptly update any changes to your information
4. CV Upload and Data Processing
By uploading your CV, you explicitly consent to:
- Processing of your personal and professional information by our AI systems
- Analysis of your skills, experience, and qualifications for job matching
- Storage of your data in encrypted format on secure servers
- Use of OpenAI's API for CV analysis and job matching (data retained for 30 days for safety monitoring)
We guarantee that:
- Your job search data will never be sold to third parties
- Your information will never be used to train AI models
- All processing is done for matching and service provision purposes only
- Your job search data remains private and confidential
5. Subscription and Payment Terms
Our services are provided on a subscription basis. Payment processing is handled securely by Stripe. By subscribing, you agree to:
- Pay all applicable fees as described in your subscription plan
- Automatic renewal unless cancelled before the next billing cycle
- Our refund policy as outlined in your subscription agreement
Cancellation Process
You may cancel your subscription at any time by:
- Using the cancellation option in your account settings
- Contacting our support team at equipa@okemprego.com
- Cancellations take effect at the end of your current billing period
- No refunds for partial billing periods unless required by law
6. Privacy and Data Security
We take your privacy seriously and implement industry-leading security measures:
- Encryption: All data is encrypted at rest and in transit
- Access Control: Strict access controls and authentication protocols
- Infrastructure: Secure hosting on Cloudflare and Vercel platforms
- Monitoring: Continuous security monitoring and threat detection
- Compliance: Full GDPR compliance and data protection standards
7. Third-Party Services
Our platform integrates with trusted third-party services to provide our functionality:
- OpenAI: AI-powered CV analysis and job matching (data retained for 30 days for safety monitoring)
- Cloudflare: Secure content delivery and DDoS protection
- Vercel: Secure application hosting and deployment
- Stripe: Secure payment processing
- AWS SES: Secure email delivery
- Analytics: Google Analytics, Microsoft Clarity, and PostHog for service improvement
All third-party services are bound by Data Processing Agreements (DPAs) and security standards that we have vetted for compliance.
8. User Responsibilities
You agree to:
- Provide accurate and truthful information in your CV and profile
- Use our services only for legitimate job search purposes
- Not attempt to circumvent our security measures
- Not upload malicious files or content
- Respect intellectual property rights
- Comply with all applicable laws and regulations
9. Intellectual Property
You retain ownership of your CV content and personal information. We retain ownership of our platform, algorithms, and generated insights. You grant us a limited license to process your data solely for providing our services.
10. Limitation of Liability
While we strive to provide accurate job matches and insights, we cannot guarantee employment outcomes. Our liability is limited to the amount paid for our services in the preceding 12 months, except for:
- Data breaches caused by our negligence (liability cap: £100,000)
- Death or personal injury caused by our negligence (unlimited)
- Fraud or fraudulent misrepresentation (unlimited)
- Any other liability that cannot be excluded by law
11. Termination
You may terminate your account at any time through your account settings or by contacting us. Upon termination:
- Your subscription will be cancelled at the end of the current billing period
- Your personal data will be deleted within 30 days of account closure
- Some data may be retained longer for legal compliance (billing records: 7 years)
- You can request immediate data deletion by contacting dpo@okemprego.com
12. Changes to Terms
We may update these terms periodically. We will notify you of significant changes via email or platform notification. Continued use constitutes acceptance of updated terms.
13. Governing Law and Dispute Resolution
These terms are governed by the laws of England and Wales. Any disputes will be resolved through:
- First: Good faith negotiation between the parties
- Second: Mediation through a mutually agreed mediator
- Final: Binding arbitration in London, England, except for:
- Data protection violations (may be brought in any competent court)
- Intellectual property disputes
- Claims under £5,000 (may be brought in small claims court)
Arbitration Opt-Out: You may opt out of arbitration by sending written notice to equipa@okemprego.com within 30 days of account creation.
